European law has required synthetic content to carry machine-readable marks since 2 August, but artistic and satirical work gets the lightest disclosure obligations of all. Pope Leo XIV has told artists there is an ontological difference between art and what a machine produces.

European law already requires that difference to be marked. It asks least of exactly the work he was describing. He spoke on Friday in the Consistory Hall, to artists and curators at a meeting run by the Vatican’s Dicastery for Culture and Education, which published the address. A condensed version went out on the papal account.

Algorithms, he said, lack the spark of the human. The difference comes before aesthetics, he argued, between art and what a machine generates by statistical calculation from millions of images created by others. The Church wants to renew an alliance with artists and cultural institutions. The distinction he is asking for became a legal obligation in Europe two months ago.

His May encyclical ran to 42,300 words and addressed the industry directly, in terms we described as reading as tech regulation. Friday was the same argument applied to pictures. Under the AI Act, providers must embed machine-readable marks so synthetic images, audio, video and text can be detected. Fines reach EUR 15M or 3% of global turnover.

Those labels became compulsory on 2 August, with marking for older systems allowed until December. Art is where the law relaxes. Disclosure for artistic and satirical work must not spoil the experience, and clearly unrealistic content falls outside the rules. Text a human has meaningfully reviewed needs no label at all.

The marking is fragile anyway. Anthropic shipped a text watermark on 2 August and tools to remove it appeared within days, one reaching 14,000 GitHub stars. A machine-readable flag records how something was made. It does not carry the difference the Pope is describing, which is a claim about what the thing is.

His own camp has met that limit. In July, to show his book was human, it turned to AI detectors rather than to any mark. The audience is the other half. The Church counts 1.4 billion members, a larger constituency than any European regulator speaks to.

The first AI image to fool the public at scale was of a pope in a puffer coat. Europe has legislated the label. The Pope is asking for the thing the label cannot prove. Only one of them carries fines.

Pope Leo XIV recites the Angelus and imparts his blessing at the gates of the Apostolic Palace before thousands of faithful in Castelgandolfo.
